{"id":13395,"date":"2026-05-19T12:53:19","date_gmt":"2026-05-19T12:53:19","guid":{"rendered":"https:\/\/medical-article.com\/?p=13395"},"modified":"2026-05-19T12:53:19","modified_gmt":"2026-05-19T12:53:19","slug":"medicare-drug-price-negotiation-is-here-to-stay","status":"publish","type":"post","link":"https:\/\/medical-article.com\/?p=13395","title":{"rendered":"Medicare Drug Price Negotiation is here to stay"},"content":{"rendered":"<p>At least, it won\u2019t be overturned by the US Supreme Court. <a href=\"https:\/\/endpoints.news\/the-supreme-court-wont-take-up-drugmakers-ira-cases\/\">Endpoints reports<\/a>:<\/p>\n<p>The Supreme Court says it won\u2019t wade into the pharma industry\u2019s yearslong legal battle over Medicare drug price negotiations.<br \/> The justices declined to review multiple cases brought by AstraZeneca, Johnson &amp; Johnson, Bristol Myers Squibb, Novo Nordisk, Novartis and Boehringer Ingelheim\u2026<br \/> The drugmakers have challenged the process on a range of constitutional and statutory grounds, including that it restricts their free speech or due process rights.\u00a0Some companies have also challenged CMS\u2019 interpretation of the Inflation Reduction Act. For example, Novo Nordisk said CMS\u2019 definition of a \u201cqualifying single source drug\u201d unlawfully allowed the agency to negotiate the price for multiple formulations of its Novolog and Fiasp insulin products.<br \/> A Supreme Court opinion could have brought some finality to those arguments. <\/p>\n<p>While future administrations could of course modify the <a href=\"https:\/\/www.cms.gov\/priorities\/medicare-prescription-drug-affordability\/overview\/medicare-drug-price-negotiation-program\">Medicare Drug Price Negotiation<\/a> program in the future, it looks like it will not be struck down by the legal system.
